The specified person shall not include a non-resident who does not have a permanent establishment in India. <\/p>\n\n\n\n (W.e.f 1st April 2022,<\/strong> specified person\u201d shall mean a person who has not furnished the return of income for the assessment year relevant to the previous year immediately preceding the financial year in which tax is required to be deducted, for which the time limit for furnishing the return of income under sub-section (1) of section 139 has expired and the aggregate of tax deducted at source and tax collected at source in his case is Rs. 50000\/- or more in the said previous year)<\/p>\n\n\n\n Section 206AB is not applicable to case tds of deductible under section 192, 192A, 194B, 194BB, 194LBC, 194N and (194IA, 194IB and 194M are included w.e.f. 1st April 2022)<\/strong><\/p>\n\n\n\n (4) Section 194S inserted by Budget 2022<\/strong><\/p>\n\n\n\n TDS @ 1% on transfer or exchange of virtual digital assets is to be deducted w.e.f. FY 2022-23. Wwhere the consideration for transfer of virtual digital asset is (a) wholly in kind or in exchange of another virtual For the purposes of this section \u201cspecified person\u201d means a person,\u2013<\/strong> (5) Surcharge on TDS:-<\/strong><\/p>\n\n\n\n (7) As per circular no. 1\/2014 dated 13-01-2014, No TDS is to be deducted on service tax component included in the payments made to residents.<\/p>\n\n\n\n (8) If PAN of deductee is not intimated to the deductor, TDS will be deducted either at the rate given in above table or 20%, whichever is higher (Sec. 206AA) But in case of section 192A (TDS on Employees Provident fund balance) TDS @ 30% is deducted if valid PAN is not available.<\/p>\n\n\n\n If TDS is not deducted then interest @ 1% per month or part thereof, for the period from the date on which TDS is deductible\/collectible to the date on which TDS\/TCS is actually deducted\/collected.
